1. Agreement

This website is operated by S ET Y LLC, a Wyoming limited liability company trading as Everwear Studios, 30 N Gould St, Ste R, Sheridan, WY 82801 (“we”, “us”). By browsing this site or placing an order you agree to these Terms of Service. If you do not agree, do not use the site.

2. Eligibility

You must be at least 18 years old, or have the consent of a parent or guardian, and be able to form a binding contract under US law.

3. Accounts

You are responsible for keeping your account credentials confidential and for all activity under your account. Tell us immediately if you suspect unauthorised use.

4. Products and pricing

We aim to display colours and details accurately, but your screen may render them differently. Prices are in USD and may change without notice. We reserve the right to correct pricing or description errors and to cancel any order placed at an incorrect price, refunding you in full.

5. Orders

Your order is an offer to buy. A contract is formed only when we dispatch the goods. We may refuse or cancel any order — for example if an item is out of stock, if we suspect fraud, or if there has been a pricing error. If we cancel after payment you are refunded in full. We may limit quantities per customer or per order.

6. Payment

Payment is taken at checkout through our payment providers. By submitting payment details you represent that you are authorised to use the payment method and that the information is accurate. Applicable sales tax is calculated at checkout.

7. Shipping and returns

Delivery and returns are governed by our Shipping Policy and Refund Policy, which form part of these terms.

8. Intellectual property

All content on this site — text, photographs, logos, graphics and design — belongs to S ET Y LLC or its licensors and is protected by United States and international intellectual property law. You may not copy, reproduce or redistribute it without our written permission.

9. Acceptable use

You agree not to use the site unlawfully, to attempt to breach its security, to scrape it at scale or by automated means, to introduce malicious code, or to resell our products as authorised Everwear stock without a written agreement.

10. Third-party links

The site may link to third-party sites and services we do not control. We are not responsible for their content, products or privacy practices.

11. Disclaimer of warranties

Except as expressly stated, the site and the products are provided “as is” and “as available”. To the fullest extent permitted by law we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement. Some states do not allow such exclusions, so parts of this section may not apply to you.

12. Limitation of liability

To the fullest extent permitted by law, our total liability arising out of any order is limited to the amount you paid for that order. We are not liable for indirect, incidental, special or consequential damages, or lost profits. Some states do not allow these limitations, so parts of this section may not apply to you. Nothing here limits liability that cannot lawfully be limited.

13. Indemnity

You agree to indemnify and hold harmless S ET Y LLC and its members and agents against claims arising from your breach of these terms or your misuse of the site.

14. Dispute resolution and arbitration

Most concerns are resolved by emailing us first, and we ask you to contact us before starting formal proceedings.

If a dispute cannot be resolved informally within 30 days, you and we agree that it will be settled by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, seated in Sheridan County, Wyoming, or conducted remotely at your election. You and we waive the right to a jury trial and to participate in a class action.

You may opt out of this arbitration agreement by emailing support@eeverwearstudios.com within 30 days of your first order, stating your name, order number and that you opt out. Opting out does not affect the rest of these terms. Either party may bring an individual claim in small claims court instead.

15. Termination

We may suspend or terminate access to the site at any time for breach of these terms.

16. Governing law

These terms are governed by the laws of the State of Wyoming, without regard to its conflict of laws rules. Subject to section 14, the state and federal courts located in Sheridan County, Wyoming have exclusive jurisdiction. Nothing here removes consumer protections that apply in your state of residence and cannot be waived.

17. Severability and entire agreement

If any provision is held unenforceable, the rest remains in force. These terms, with the policies referenced, are the entire agreement between us.

18. Changes

We may update these terms. The version in force is the one published on this page at the time of your order.
